You must read and agree to these Terms and Conditions before ordering from Kups Food Qawra Ltd. By placing an order with Kups Food Qawra Ltd, you agree to be bound by the following Terms and Conditions:

By accessing, using, or ordering products through the Website, you affirm that you have read this Agreement and understand, agree, and consent to all Terms contained herein.

These Terms of Use constitute the entire agreement between Kups Food Qawra Ltd and you, and supersede all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the Website, the content, products, or services provided by or through the Website, and the subject matter of these Terms of Use. You understand that all our items are food products. While Kups Food Qawra Ltd endeavors to provide accurate information about our Products, the statements regarding these products have not been evaluated by health authorities. These products are not intended to diagnose, treat, cure, or prevent any disease.

You understand the information on this Website or in emails is designed for educational purposes only and is not intended to be a substitute for informed medical advice or care. You understand you should not use this information to diagnose or treat any health problems or illnesses without consulting your doctor. Our products are intended for consumption, and you should consult a physician if you have any concerns or dietary restrictions.

CREDIT CARD DESCRIPTOR

By ordering products from us, you authorize us to charge your credit card accordingly (once). This authorization will be automatically removed once the order is completed, and your credit card information will need to be re-entered for future orders. Please note that the descriptor (or subject line) that appears on your credit card statement will appear as shop.kups.com.mt. If you have any questions regarding your credit card statement, you should call our customer service department.

DELIVERY AND PICKUP POLICY

All deliveries are completed on the same day as the order is placed, within our operational hours from 12:00 am to 12:00 pm CET. Deliveries are available across Malta, and are conducted using our own fleet of scooters. Tracking details will be provided via email once the order has been dispatched.

REFUND AND RETURN POLICY

Given the nature of our products, which are perishable food items, all sales are final once the product has been dispatched. However, under European Union law, customers are entitled to request a refund within 30 days from the date of receipt if the product is found to be faulty, damaged, or not as described.

If you believe there has been a mistake with your order or the product was delivered in unsatisfactory condition, please contact our customer service immediately at +356 2133 8873 or info@kups.com.mt.

Refunds will be processed for damaged or spoiled products provided that you notify us within 24 hours of receipt. You will need to return the product to our facility at your own expense, and upon receipt, we will issue a full refund, including the cost of return shipping. Refunds are credited back to your original payment method and may take up to 10 business days to process.

In the event that you need to request a refund due to an unauthorized transaction, contact us directly at the information provided. Refunds for unauthorized transactions will be processed within 10 business days and applied back to your original payment method.

LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTY

THE MATERIALS AND PRODUCTS CONTAINED AND OFFERED ON THE WEBSITE ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. IN NO EVENT SHALL KUPS FOOD QAWRA LTD OR ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, INDEPENDENT CONTRACTORS, TELECOMMUNICATIONS PROVIDERS, AND AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, UNDER ANY CAUSE OF ACTION WHATSOEVER INCLUDING, BUT NOT LIMITED TO, CONTRACT, TORT, STRICT LIABILITY, WARRANTY, OR OTHERWISE, FOR ANY CLAIM CAUSE OF ACTION, FEE, EXPENSE, COST, OR LOSS (COLLECTIVELY, “CLAIMS”) ARISING FROM OR RELATED TO THIS AGREEMENT, THE PRIVACY STATEMENT, THE PRODUCTS, OR THE CUSTOMER’S USE OF THE WEBSITE OR ANY PRODUCT.

GOVERNING LAW

You agree that this Agreement and any issue or dispute arising out of or otherwise related to this Agreement or with your use of our Website, Intellectual Property, the Terms of Use, the Privacy Statement, or any matter concerning Kups Food Qawra Ltd shall be governed exclusively by the laws of Malta and applicable European Union regulations, excluding its conflict of law provisions.
